Terms and Conditions
myStarjob.com’s ‘Ultimate De-Stress Getaway Contest’ (“Facebook Contest”) belongs to MyStarJob Network Sdn Bhd (“Organiser”) and is open to all Malaysian residents aged 18 years old and above (“Participants”). The following group of persons shall not be eligible to participate in the Contest, namely employees of the Organiser (including its parent company, affiliated and related companies), distributors, representatives, vendors, sponsors and/or agents of advertising and/or promotion service providers of the Organiser (including its affiliated and related companies) and their immediate family members.
The Contest will commence from 4th December 2013 at 12pm and ending on 15th January 2014 at 6pm (“Contest Period”).
To participate and qualify for the Contest, Participants must complete the following:
1.‘Like’ myStarjob.com’s Facebook fan page
2.Submit their personal details (Name, E-mail, Contact Number and NRIC)
3.Upload a ‘Ultimate De-Stress’ photo (“Submission”)
4.Share their entry to their friends and family to get votes
Winners may upload multiple photos but the winning photos will be judged based on the number of votes received per photo. Each winner can only win 1 prize and each winner may only win once. Votes will be counted separately based on a per photo basis. Judges will not combine the votes of multiple photos by one participant.
Only 3 winners will be selected for this contest.
Winners will be chosen according to the highest number of votes.
Three (3) Grand Prize Winners will be selected based on the number of votes. The top three (3) photos with the highest number of votes will be selected as the Grand Prize Winners. In the event of a tie, the tie-breaker will be judged based on the Entrant’s creativity in expressing their Ultimate De-Stress moment. The judges shall comprise of selected myStarjob.com employees.
The Organiser has absolute right to withhold the prizes from the winners if in its sole opinion believes that any incorrect information was provided, or if it discovers any misuse of technology to gain extra votes or to win.
The Organiser has absolute right to disqualify a winner if in its sole opinion believes that the votes were fakes.
The Organiser reserves absolute right to disqualify votes if it has grounds to suspect that fraudulent, excessive or suspicious patterns of voting have occurred or if it considers there has been any attempt to rig the voting. If any cheating is suspected, the Organiser reserves absolute right to investigate and verify the votes allocated against any photos.
The Organiser has the right to select another winner if it suspects the involvement of any suspicious activities in the votes or selection of the original winner.
Suspicious activities/Cheating are include:
I) Buying votes or likes from any 3rd party websites or groups
II) Fake accounts or multiple identity accounts owned by same owner used for artificially increasing votes
III) Misuse technology to gain extra votes
Submissions must not contain obscenity, explicit sexual material, nudity, profanity, graphic violence, calls or incitement to violence, commercial solicitation or commercial promotion. Submissions must conform to local laws and must not contain content or images that could be considered abusive, inflammatory, denigrating, or disrespectful to the Organiser, Contest Sponsors, or to any groups, individuals or institutions. Submissions must adhere both in appearance and in fact to the norms of civil discourse. In other words, the content of all Submissions must be suitable for a global, public audience.
Submissions must be original content created by the Contestant and must not contain any elements that are protected by someone else’s copyright or otherwise subject to third party intellectual property or proprietary rights, including privacy and publicity rights (except as expressly permitted below in (8)). Contest Sponsors recognize no allowance for “fair use” of copyrighted material, nor do Contest Sponsors recognize allowance for use of licensed materials created or owned by a third party.
The Organiser reserve the right to disqualify, at their sole and absolute discretion, any Submission that does not adhere to these criteria and to the intent and substance of these Official Contest Rules.
By submitting a photo to the Contest, the Contestant affirms that he or she has obtained written consent from all individuals whose image or likeness appears in the photo (or from the individuals’ parent/legal guardian if any such individuals are considered a minor in their country of residence), and that he or she has obtained the necessary rights, licenses, consents, and permissions to use all material such as music, images, text and other content in the submission. The Contestant further affirms that he or she is prepared to provide reliable documentation of any and all such consents, licenses, etc., upon request. Failure to obtain such rights, license consents, and permissions may result in the disqualification of the Photo Submission at the Contest Sponsors’ sole and absolute discretion.
In the event of any question or difference of view regarding compliance with, interpretation, or application of these Content requirements or other provisions of these Official Contest Rules, the Contest Sponsors reserve the exclusive right to resolve such questions or differences of view in their sole discretion.
Winners will be notified via email and/or telephone, as the case may be and all prizes will be couriered to the winners’ address registered with the Organiser within three (3) months from the date of notification. The Organiser will not be held responsible for non-receipt or delayed delivery of the postal notification and prizes to the winners.
In the event that any of the prizes is unavailable, the Organiser may substitute any of the prizes with any other products of similar value. All prizes are given on an “As Is, Where Is” basis and are not exchangeable for cash, credit or other prizes, whether in part or in whole.
The Participants hereby acknowledge and agree that the Organiser excludes all warranty and/or liability in connection with the awarded prizes and/or the Contest. Participants shall assume full liability and responsibility in case of any liability, mishap, injury, loss, damage, claim or accident (including personal injury and/or death) resulting from their participation in the Contest, redemption and/or usage of the prizes. The Organiser shall not be held responsible for any liability, mishap, loss, damage, claim or accident (including personal injury and/or death) in any manner whatsoever suffered by the Participants as a result of the participation in the Contest and/or the use of the prizes.
All costs, fees and/or expenses incurred or to be incurred by the Participants in relation to the Contest and/or to claim the prizes, which shall include but not limited to the costs for transportation, postage/courier, personal costs and/or any other costs, are the sole responsibility of the Participants. The winner(s) must abide by all laws and regulations currently in place and the terms and conditions of the party(ies) arranging and/or providing the Prize and the terms and conditions attached to the Prize, if any. The winner(s) shall be wholly responsible for the payment of all taxes, insurance and/or other miscellaneous charges relating to the Prizes.
By accepting the prizes, the winners hereby expressly and irrevocably agree that the Organiser reserves the right to publish and/or use his/her submissions, name, photographs, voices and/or appearances (“Materials”) as the Organiser deems fit for the purposes of advertising and/or trade publicity without prior notice. The winner(s) hereby agree that he/she shall not be entitled to claim ownership or copyright or other forms of compensation on the Materials.
The Organiser’s decisions regarding all aspects of this Competition including, without limitation, decisions regarding the eligibility of entries, the conduct of the Competition, the selection of the Winner, the interpretation of these Terms and the allocation of the Prize, are final.
No correspondence will be entertained.:
a. No decisions of the Organiser may be challenged on any grounds, including (without limitation), due to any alleged or actual failure of the Organiser to act reasonably, in good faith, or fairly; and
b. The decisions of the Organiser will remain binding and conclusive even if those decisions were allegedly or actually wrong or based on any factual error or based on any unreasonable, irrational, or irrelevant consideration.
The Organiser’s decisions are final and conclusive and the Participants hereby agree to abide by the decisions of the Organiser. No correspondence will be entertained and all Participants shall not resort to court proceedings to review the Organiser’s decisions.
Cancellation, changes or substitution: The Organiser reserves the right to cancel this Competition, or to change any condition of this Competition, without notice. The Organiser reserves the right to substitute a Prize or any part of a Prize (due to unavailability or for any other reason) with a different Prize or part of a Prize of equal or greater monetary value.
By participating in the Contest, the Participants hereby confirm having read and fully understood all the terms and conditions contained in these Official Contest Rules and hereby agree to be bound by these Official Contest Rules at all times.
The Organiser reserves the absolute right to review and/or vary the above mentioned terms and conditions as and when it deems fit without giving any prior notice to the Participants.
The Organiser may forthwith disqualify/discontinue any of the Participants from the Contest in the event he/she breaches any terms contained herein.
The terms and conditions contained in these Official Contest Rules shall be governed by and enforced in accordance with the applicable laws of Malaysia. If any provisions of these Official Contest Rules are held by a court of competent jurisdiction to be void or unenforceable, the remainder of these Official Contest Rules will remain in full force and effect.
